[side note: There's no discussion forum, so I'll post here]
-waves arms- It's been brought to my attention that there may be a ban against the insanity plea in court.
How can that be fair to the people who are insane? They can't control what they do and yet we give them the same punishment as killers that kill on purpose? What happens when they find themselves and realize they're in jail for reasons they don't know? Is that fair to them? At least if they're sent to an asylum they can understand, because of moments missing from their lives or for uncontrolable urges. An Asylum is less than greatbut , at least they're treated better, get treated, are safer, and it's not prison.
Now I've heard people speak of the liars that are not insane but use the plea. There are ways now that psychologists can tell the difference between the sane and insane, and for those that still manage to fool them are still sent to the asylum, but may be released back into society.
I'm against the ban, but with it as well.

Aw come on!
Ban it and through crazy people in a jail with the already sadistically sick?! If it happens all I can see are more jail riots and fights and situations prisons or penitentiaries cant handle.
I say keep the plea and test those who use it.

I agree with both of you. Although, rather than make it an optional plea you can use, they should just test you to see if you're mentally ill in any way, that way they can be sure and the people can't lie.

Well, Some people have bouts of instability, while others might lose their sanity because of certain cues. The thing is, just because you're ill while you're in court, doesn't mean you were ill while you were committing the crime.
